What You Need for a Jackson County Marriage License

Both people getting married must appear in person at the same time. You cannot have one person apply first and the other come later. Each applicant needs a valid government-issued photo ID. A Minnesota driver's license, state ID, or passport works. Out-of-state IDs are also acceptable as long as they are current and government-issued.

Bring a certified copy of the divorce decree or death certificate if either applicant was married before. This proves that the prior marriage legally ended. The document needs to be a certified official copy. A scan or photocopy will not be accepted. If you have any questions about what counts as acceptable documentation, call the recorder's office before your visit.

The fee is $115 to $125. If you bring proof of completing a 12-hour premarital education program, you may qualify for a reduced fee. Under Minn. Stat. § 517.04, applicants must be at least 18. Those ages 16 to 17 need written parent or guardian consent. There is no residency requirement and no blood test. Minnesota has had no waiting period since September 2016, so you can marry on the same day you pick up your license if you want. The license is valid for six months from the date of issue.

Jackson County Marriage Records Search

The Minnesota Official Marriage System (MOMS) covers Jackson County records from 1858 to the present. That is nearly 170 years of marriage records searchable for free online. MOMS lets you search by name, county, and date range. It is run by the Minnesota Department of Health and is the main public-facing tool for marriage record research in Minnesota.

The depth of the Jackson County index, going back to 1858, makes it particularly useful for genealogy researchers tracing families in southwestern Minnesota. Not every record from the 1800s may be fully digitized, but the index provides enough detail to locate specific records and order certified copies.

For certified copies, contact the Jackson County Recorder at 507-847-4030 or reach out to the Minnesota Department of Health Vital Records office. MDH charges $9 per certified copy. The MDH county registrar directory confirms the Jackson County Recorder as the local contact for vital records requests.

Note: For very early records predating the MOMS index, the Minnesota Historical Society marriage records guide points toward additional sources including territorial records and church registers that may fill gaps in the official county index.

After Your Wedding in Jackson County

The officiant who performs your marriage ceremony is legally required to complete the marriage license and return it to the Jackson County Recorder within 5 days of the wedding date. This requirement comes from Minn. Stat. § 517.13. Once the county receives the completed license, they register it locally and forward it to the Minnesota Department of Health for statewide registration.

After MDH processes the record, it becomes part of the permanent vital records system. At that point, certified copies are available from both the county and MDH. Most people need a certified copy within a few weeks of the wedding for name change paperwork. The standard MDH copy costs $9 and is accepted by the Social Security Administration, DMV, banks, and other institutions. If you need the record for use in another country, an apostille from the Minnesota Secretary of State costs $5 per document and authenticates it for international use.
